Update for XRP Holders: US House Just Put CLARITY Act At Risk. Here’s What Happened

The U.S. House of Representatives has canceled the final two weeks of its September session. Members leave Washington by September 17 and will not return until mid-November.

That decision has created a critical timing problem for the Digital Asset Market Clarity Act, known as the CLARITY Act. The Senate’s first procedural vote on the bill is scheduled for September 15. That gives both chambers just two days of overlap before the House departs.

Where the Bill Stands

The CLARITY Act passed the House in July 2025. It cleared the Senate Banking Committee in May. The September 15 vote is a cloture vote on the motion to proceed, requiring a 60-vote supermajority. All 53 Senate Republicans are committed to voting yes, leaving a 7-vote gap that must come from Democrats.

The House Whip Speaks

House GOP Majority Whip Tom Emmer made his frustration public. He said the House passed the CLARITY Act over a year ago with nearly 100 Democratic votes, and that the bill has since sat idle in the Senate. His message was clear. The House has acted while the Senate has failed to.

That position now carries an ironic edge. If the Senate passes an amended version of the bill, the House must approve those changes. Members will not be in Washington to do that. Emmer’s criticism of Senate inaction now runs up against his own chamber’s absence.

What Comes Next?

Senator Cynthia Lummis has closed the door on further negotiation. She has stated the Senate should vote and let the outcome stand. Lummis has also warned that failure to pass the bill before the midterms could push meaningful crypto legislation as far out as 2030

The September 15 cloture vote is the immediate test. If it clears 60 votes, Senate debate begins. Whether that process concludes before September 17 now determines the CLARITY Act’s fate in 2026.
